Warranty Policy


At Cybeart we take pride in our effort to provide aesthetically designed and manufactured products with the highest-grade materials. Our products are fully certified by the world’s top established industry standards such as but not limited to SGS, BIFMA, TUV, SUD. Because we believe in the quality of our products, we are also providing the extensive warranty policies for them. The document below refers to the Cybeart Limited Warranty (“Warranty”) Policies for each of our products.

Note: This Limited Warranty policy is valid only in Canada. Unless products are exclusively sold overseas by Cybeart’s sales channel, our Warranty will not cover the products used overseas. The Warranty does not override any statutory rights that cannot be waived or limited by contract. Consumers are free to make a warranty claim under the Warranty. They may also exercise their statutory consumer rights, to the extent applicable.

*Except as expressly provided in this Warranty, Cybeart excludes all express and implied warranties or conditions, including any implied warranties of merchantability and fitness for a particular purpose under any Federal, State/Provincial or National legislation governing the sale of consumer goods. For consumer transactions, the Warranty terms contained in this policy, except to the extent lawfully permitted, do not exclude, restrict, or modify, but are in addition to the mandatory statutory rights applicable to the sale of the products to the purchaser.

*This Limited Warranty is valid only for products bought through our online store (www.cybeart.com) or one of our physical stores selling Cybeart products exclusively (together, the “Stores”). Products bought via other channels or person(s) are not covered under this Warranty.

Warranty Terms common for all products

A. What we cover under this Warranty

  • This Warranty covers any defects in material or workmanship under normal use during the Warranty Period of each product specific to its parts as defined under Sections 2, 3 and 4;
  • During the Warranty Term, Cybeart will repair or replace, at no charge, products or parts of a product that prove defective because of improper material or workmanship, under normal use and maintenance;
  • The product you bought will match the descriptions provided to you through our Stores or when you contacted us;
  • The product will fit your particular purpose if such was expressly stated by our Stores or you were informed of same, in writing, when you contacted us. We do keep records of all correspondence and communications and the above criteria will be based on our records.

B. What we don’t cover under this Warranty

Our Warranty does not cover any claims derived from:
  • Conditions, malfunctions or damage not resulting from defects in material or workmanship of a product;
  • Damage to the product resulting from abuse, negligence, unauthorized modification of the product, accidents, shipping, fire or water damage, caused by natural disaster or causes beyond our control;
  • Theft or loss of the product;
  • Minor deviation of a product from images or videos posted in the Stores or due to naturally occurring variations in the materials used in assembly of the product;
  • Improper assembly of the product or use or environmental conditions;
  • Normal wear and tear;
  • Any condition resulting from incorrect or inadequate maintenance or care;
  • Any condition resulting from the use of a product for anything other than personal or private use or any use for which the product was not intended, including but not limited to usage in rental or contract trade or commercial use;
  • Dissatisfaction due to buyer’s remorse;
  • Any used or previously displayed items;
  • Contact of product with excessive moisture;
  • Modifications or failure to follow any recommended assembly or after-care instructions.
  • Damage resulting from any liquid or chemical spill over the product.

C. Making a Warranty claim

Please submit your warranty claim within 14 days of discovering the defect. Please use the Warranty Claim Form or email us at cs@cybeart.com to submit your warranty request. You must provide us with the order number to validate your warranty. A clear picture and video is necessary for us to examine and potentially validate the defect. We encourage you to provide us with a full description of the defect(s) as well as a brief explanation of the way the defect happened/was found. If you refuse to send us the picture/video we hold the right to reject your claim, abandon it and/or tag it as invalid.

D. What we will do to fulfill Warranty claims

To make the process easier, we have decided to enable you to perform self-service to some of our products. In a situation where the self-service is possible and permittable, we will ship the replacement parts to you at no charge and will provide guidelines as to how to perform the necessary assembly/repair. You may choose to hire a third-party contractor for the assembly/repair for which we are not to be held responsible for any damage resulting from work of the third party, or any labor cost involved.

Replacement parts will mostly consist of new items and/or used/re-furbished items which are new in condition in terms of quality, performance and reliability. They may vary in looks from what you bought as we may have discontinued such items. In such events, we will replace your replacement part with the newest part reasonably available. Replacement items will be warrantied until the end of the warranty period for the original product or 30 days from the date you received the replacement items, whichever is later.

If we are required to pick-up faulty parts from you, we will cover all the costs involved in shipping them back to us.

Any costs associated with a part or product that needs repair/replacement after its warranty term has to paid for by you, including, but not limited to, any handling, shipping, packaging and customs duty charges.

E. Limitation on transferability of Warranties

This Warranty applies to the original purchaser only. All the subsequent owners of the Cybeart product acquire it “as is” even though a warranty may still be valid on the product purchased by the original purchaser. Any attempt to transfer any warranty in violation of this paragraph will void the warranty.

F. Limitation of our liability to you

We are liable to provide you with a product that matches the quality and description as described in the Store.

We are not responsible for any damage or injury incurred to you by your negligence, abuse, improper usage of a product or any natural disaster occurring while using a product. We are responsible only for the actual and direct damages we acknowledge in writing or you successfully prove in court; and then only to the extend provided in this Warranty. In no event will our liability towards you exceed the price you paid for a product.

G. Governing Law

This Warranty and any claim arising here from shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein and the parties attorn to the exclusive jurisdiction of the courts located in the Province of Ontario with respect to any action arising from this Warranty.

If the laws of a province in Canada require the applicability of such province’s laws and exclusive jurisdiction of the courts of such province, then any such claim shall be governed by the laws of the province and the courts of such province in which the product was purchased.

Gaming Chairs

Gaming Chairs consist of a lot of different parts. Major parts of each chair are quality and safety certified by established industry standards as well as subject to Cybeart’s testing protocols. The leather part of the chair is certified by TUV and all other parts are certified by BIFMA. Each part of the chair has different warranty coverage. Please review the table below to understand your warranty terms.

What we don’t cover under Limited Warranty of Gaming Chair:

This section consists of non-coverage terms of the Warranty specific to gaming chairs and are in addition to or including those mentioned in Section 1 (B) of this Limited Warranty Policy.

  1. All foam and filling composited naturally soften with use. This softening does not constitute a defect under the Warranty. Though we use high quality Cold Cure Foam, natural softening is bound to happen.
  2. We do not cover the pilling of the leather which is a direct result of overexposure to sunlight.
  3. Natural beauty of leather means that no two pieces of leather are exactly alike. As such, natural markings and grain variations are not considered defects for the purposes of this Warranty.
  4. Injuries caused to you by improper, abuse or negligence on usage of the product are not covered under this Warranty.

Cybeart Limited Warranty starts from the date the product is delivered at your door. We will calculate this based on our tracking records for your particular order.

Please follow the maintenance and assembly guidelines to avoid voiding the Warranty. These instructions are also included in the product packaging. Additionally, you can also view them online on our website at www.cybeart.com.

Mouse Pads

Cybeart Mousepads consist of 2 series with 2 size options in each series (RapidandAuroraSeries). The “Aurora Series” is the LED Version of “Rapid Series”. The rubber base and its manufacturing process is quality and safety certified by established Industry Standards“SGS”.

What we don’t cover under Limited Warranty of Mousepads:

This section consists of non-coverage terms of Limited warranty specific to Mousepads and are in addition to or including those mentioned in Section 1 (B) of this Limited Warranty Policy.

  1. The pilling or tearing of reinforced edge stitching (often mentioned as “Overlocking Feature” or “Never Fray Edge”) due to normal wear and tear, abuse, negligence or caused by any sharp edge.
  2. Any damage to the LED tube or its controller due to any abuse or negligence in its usage.
  3. Any damage to the LED tube or its controller due to any electrical mishap including but not limited to frying of circuit due to over power, modifying the PC software of Aurora Series to increase the intensity of light, attaching mousepad to any high-power source etc.
  4. Any chemical or liquid damage to a product.

Phone Cases

Cybeart Phone cases whether the Cybeart PRO Series or the Cybeart Impact Series are impact and shock resistant. However, they do have certain limitations as mentioned below.

This section consists of non-coverage terms of Limited warranty specific to Phone Cases and are in addition to or including those mentioned in Section 1 (B) of this Limited Warranty Policy.

  1. Normal wear and tear to the phone cases under regular usage.
  2. Damage occurring to a product if dropped or slammed at intensity or from height or in any other accidents which is not controllable by Cybeart.
  3. Scratches on the phone case is a normal behavior and scratches due to regular, improper, abuse or negligence in usage of the product will not be covered.
  4. Any kind of damage occurring to the mobile/smartphone/tablet device for any reason.
  5. Damages incurred to the design printed on the product due to improper, abuse or negligence in usage of the product.
  6. Tearing of TPU Rubber Case of Impact Series due to improper, abuse or negligence in usage of the product.
